The Warshawsky Law Firm has handled a wide variety of employment law, civil rights law, and litigation matters, including the following:

Employment Law

• Represent former federal employee in lawsuit against the Federal Aviation Administration for religious discrimination (Jehovah's Witness) and retaliation (wrongful termination) in violation of federal law.  The case is pending before the EEOC.
• Represent sales manager in lawsuit against his former employer for national origin discrimination (Polish) and retaliation (wrongful termination) in violation of the Westchester Human Rights Law.  The case is pending before the Westchester Human Rights Commission.
• Represent college administrator in lawsuit against the City University of New York for national origin discrimination (Italian-American) and retaliation (demotion) in violation of federal law.  The case is on appeal before the U.S. Court of Appeals for the Second Circuit.  Case No. 12-159.
• Represent food delivery employee in lawsuit against Mangia 57 for religious discrimination (anti-Semitic hostile work environment) in violation of federal law.  The case is pending in federal district court in Brooklyn.  Case No. 09-CV-4413 (EDNY).   
• Represented financial industry employee in negotiations with, and potential lawsuit against, private wealth management company for wrongful termination based on sexual orientation and medical leave in violation of federal and city law.  The matter was settled without litigation.  
• Represented physician employed by the NYC Department of Health in lawsuit against her employer for sex and disability discrimination, hostile work environment, and retaliation in violation of federal and city law.  The case was filed in federal district court in Manhattan, and settled before discovery.  Case No. 09-CV-8485 (SDNY).
• Represented bank employee in lawsuit against Bank of America for reverse race discrimination and retaliation (wrongful termination) in violation of federal and city law.  The case was litigated in federal district court in Manhattan, and settled after discovery.  Case No. 09-CV-9946 (SDNY).
• Represented college assistant football coach in negotiations with, and potential lawsuit against, former employer for unpaid wages and overtime.  The matter was settled without litigation.

Civil Rights Law

• Represent customer who was wrongly accused of shoplifting in lawsuit against Macy's for false arrest and false imprisonment.  The case is pending in federal district court in Manhattan.  Case No. 11-CV-6932 (SDNY).  See the complaint here.
• Represent young hispanic entrepreneur whose restaurant was forced out of business by city officials in lawsuit against the City of Poughkeepsie and individual city officials for violations of his rights to due process of law and equal protection of the laws.  The case is pending in federal district court in White Plains.  Case No. 11-CV-9726 (SDNY).  See the complaint here.
• Represent young man in lawsuit against the NYPD for false arrest and violation of his First Amendment rights after he was arrested for trying to videotape a police officer with his cell phone.  The case is pending in federal district court in Manhattan.  Case No. 11-CIV-8660 (SDNY).  See the complaint here.
• Represent homeowners in lawsuit against the NYPD for entering and searching their home without a warrant in violation of the Fourth Amendment of the U.S. Constitution.  The case is pending in federal district court in Brooklyn.  Case No. 10-CV-1624 (EDNY).
• Represented customer who was wrongly accused of shoplifting in negotiations with, and potential lawsuit against, department store for false arrest and false imprisonment.  The matter was settled without litigation. 
• Represented Staten Island family in lawsuit against the NYC Administration for Children's Services and the NYPD for entering and searching their home without a warrant in violation of the Fourth Amendment of the U.S. Constitution.  The case was tried to a jury in federal district court in Brooklyn, and subsequently settled.  Case No. 08-CV-4925 (EDNY).  N.Y. • Represented department store employee in lawsuit against J.C. Penney for false arrest and false imprisonment after she was wrongly accused of stealing from the store.  The case was litigated in federal district court in Brooklyn, and settled before trial.  Case No. 09-CV-5731 (EDNY).

Litigation

• Represent medical staffing company in preference avoidance action brought against it by bankrupt hospital.  The case is pending in federal bankruptcy court in Brooklyn.  Adv. No. 11-1073-cec (Bankr. EDNY).
• Represented beauty industry professional in negotiations with, and potential lawsuit against, international skin care company for unauthorized use of her name and photograph in advertisements.  The matter was settled without litigation.
• Represented power company customer in negotiations with, and potential lawsuit against, power company for refund of overcharges caused by faulty electricity meter. The matter was settled without litigation.
